A restaurant cashier in Kuala Lumpur was caught off guard when enforcement officers questioned her about a TV box installed in the restaurant showing pirated content. Despite her lack of knowledge about the device, she found herself in a difficult situation, highlighting the complexities of copyright infringement laws.
In December 2021, Malaysia introduced Section 43AA to its Copyright Law, targeting individuals who commit or aid copyright infringement using streaming technology. This includes both software and hardware facilitating infringement, with penalties of up to RM200,000 in fines and/or up to 20 years in jail.
The amendment stemmed from a ruling in May 2021, where the Kuala Lumpur Intellectual Property High Court declared the distribution of TV boxes or streaming devices enabling unauthorized access to copyrighted content as infringement. Despite these measures, digital piracy remains a significant issue in Malaysia, highlighting the need for stronger enforcement and public education on the legality of illicit streaming. The impact of piracy extends beyond financial losses, affecting the country's media industry, taxes, and job market.
There’s a direct link between illegal streaming and malware infections, highlighting the risks associated with accessing pirated content. Scammers often use illegal streaming sites to lure users with pirated content while silently extracting personal data. This is facilitated by malicious ads on these sites, which can lead users to websites hosting malware, phishing attempts, or scams.
Malaysia is urged to adopt more dynamic and speedy methods, such as IP blocking, to combat cyber threats effectively, especially as hackers increasingly use AI to automate their attacks.
