We Need A Proper Cyberbully Law

A new law needs to be introduced to tackle cyberbullying, especially on social media.  

UM criminologist, Dr Haezreena Begum Abdul Hamid says it’s because the current system is NOT enough to help victims...  

"You can report to MCMC, and even META and TikTok say that you can report to us if it’s bullying or harmful content, but that doesn’t solve the issue because it will just get that particular posting removed."  

Dr Haezreena pointed out that there ARE existing laws to deal with cyberbullies, depending on the specific nature of each case.  

For example, action can be taken under the penal code for criminal intimidation, or uttering statements that can violate a person’s modesty. 

There is also the Communications and Multimedia Act, and the Defamation Act.  

But the problem is that these laws have a limited scope, as none of these laws refer to or specifically mention bullying or cyberbullying.  

But what should any potential Cyberbullying Law cover? 

Dr Haezreena told us it must clearly define bullying and cyberbullying, and punish offenders with jail time, fines or community service.  

Meanwhile their victims MUST be compensated with monetary damages and a public apology. Also the victim must be given mental health treatment. 

She also pointed out that this matter needs urgent attention, because cyberbullying are more prone to having suicide ideation, compared to victims of conventional bullying...  

"Because conventional bullying, you can pinpoint who is harming you and it’s easier for police to investigate, but when a person is cyberbullied, sometimes you don’t even know who the person is. Even if the victim knows, its not easy to get evidence."

The government is currently looking into cyberbullying, following the recent suicide of a local social media influencer.
